Product liabilities come under that section of the law in which people like the manufacturers, distributors, suppliers as well as retailers, and associated others make defective products that cause injury to the public. Product liabilities hold them accountable for this. It is a given that the term product carries with it a wide range of meaning. In general, it is applicable to personal property in the tangible form.

There are a few theories of liabilities in the US with regards to product liabilities claims. The claims here largely cover negligence, strict liability and breach of warranty. It also includes several consumer based protection claims. Most claims are filed at the state level and the laws governing these product liabilities cases vary with each state. Depending on the case, there are several aspects that need to be proven in order to make a successful claim.

Product liabilities are of three basic types - a manufacturing defect, a design defect and a failure to warn. This last one is also known as a marketing defect. But in most states, these do not constitute absolute grounds for the case. It varies depending on the claim and the injured party.

Manufacturing defects is when there is a flaw in the manufacturing process and low quality raw materials are used. It can also be the result of bad workmanship. A design defect is when the creation of the product is such that it is dangerous to the user and therefore considered defective. This can be demonstrated with effective tests of the product and its inability to match up to required standards. A marketing defect is when you do not take the trouble to inform the public about the potential of some harm being caused with the use of the product.

There is also what is known as breach of warranty-based product liability claims. These are three common forms - a breach of express warranty, a breach of implied warranty of merchantability, a breach of an implied warranty of fitness.

In all cases it is necessary to engage the services of a legal expert in the field. This would be necessary in order for you to file the case in the right manner and get what is rightfully due to you.

3 Things to Consider When Choosing A Divorce Lawyer

If you are reading this article, you have my condolences. You are probably either about to file for divorce or you have just been served with divorce papers. Divorce is an emotional and extremely stressful time in a person's life, whether you are filing or responding, as you are dealing with the end of your marriage. During this time, people often reveal their true character. People who are jerks become even bigger jerks because a former loved one is now the enemy. In some instances, the person you thought you married becomes a complete stranger, doing spiteful things you never imagined possible. That adage that, "Hell hath no fury like a woman (or man!) scorned," holds true in the divorce context. A jilted lover is ever that much more jilted when they're about to lose half their house and pension. And so, with the battle lines drawn, when you choose your legal champion, consider the following three factors:

1. Communication Is Key

You will probably be on an emotional roller coaster for the duration of the proceedings, so it is important that you find an attorney with whom you can comfortably communicate and express your feelings. (Aside - don't use your attorney as a therapist! It's much cheaper to use a counselor.) Many people prefer either a male or a female attorney for whatever reason. Some people prefer their attorney to be one gender or another or to have a certain kind of demeanor, whether it be aggressive or more conservative. The important thing is that you have a feeling of rapport with your attorney and be able to communicate with your lawyer. Using the battle metaphor from above, what's the point of having a "warrior" if he attacks the wrong target or leaves your important issues undefended? You must not only be able to communicate, but also the attorney must be able to hear what you want to get out of the proceedings and be able to respond to you. A good attorney will listen to you and help you set reasonable expectations about the resolution of your issues and (hopefully) the entire case. Communication is not just taking orders from a client (or the opposite - the attorney telling the client how the case will unfold). If every attorney blindly followed their client's orders, the courts would be even more crowded than they already are. So true communication between the attorney and client is paramount. In a similar vein, if your lawyer doesn't return your phone calls and you still have money left in your retainer, that may be a sign that communication is a problem.

2. Experience Is Vital

At the risk of sounding jaded, it is more likely your attorney went to law school to become rich than to help others. Most of my original lawschool classmates did not drive fancy cars, mostly because it snowed heavily where I originally attended law school and a jeep or other 4 wheel drive vehicle was the practical choice. When I went down to Southern California to finish law school, I was shocked to see a large number of Mercedes and BMWs in the student parking lots, driven of course by kids who had yet to work an honest day in their lives. They had access to money and had a very expensive lifestyle to maintain once they were taken of their parent's dole. Quite a few fledgling attorneys hang their own shingle after passing the bar and set their hourly rate at $250 or more. It is engaging in a bit of speculation to say, but I would guess that they are merely playing a confidence game and that they get away with it because clients for the most part do not know how to tell how experienced a lawyer is. Well, here's a litmus test. In California, the lower the bar number, the older the lawyer (in "bar" years). At the time of this writing, bar numbers for new California attorneys is in the 270,000's (more than 40,000 California attorneys have entered the profession since I was minted). Put another way, you have a 20% chance of hiring a lawyer out there in the marketplace who's been at his or her job 5 years or less! To put that in perspective, consider how long you've been at your job and how good you are at it. Lawyering is a complicated job requiring many different skills. Accordingly, it takes quite a bit of time to develop good lawyering skills. You should be blunt and ask your attorney how many cases of your particular type or with your particular issues have they dealt with. Another word for a generalist is someone who's done a lot of different things once or twice. Compare that to someone who restricts his or her cases to a particular branch of law. When interviewing a lawyer, don't be led astray with puffing like, "I've never lost at trial." The logical thing to ask is, "How many contested trials have you had?" How many divorce cases have you handled from start to finish? How many domestic violence restraining orders have you defended? or brought? Experience and expense generally go hand in hand. If your attorney is charging you $300 or $400 per hour, they had better have quality time in the trenches to back up their hefty price tag.

3. Cost Is Always A Factor

Your attorney's hourly rate should be a function of experience and skill, not of your attorney's desire for the latest sports car. Once you have established your attorney's skill level (even as a layperson you should be able to use your common sense to estimate your attorney's experience and skill), you should ask yourself whether the attorney's hourly rate is in line with other attorneys of similar skill and experience. A newbie might charge you $150 per hour, but may be charging you for their learning curve. A simple motion to compel, for example, should not take 40 hours of research and drafting. Granted, your newbie might take twice as long to do something as a lawyer who charges $300 per hour, so perhaps you may think you're damned if you do and damned if you don't, and you'll wind up paying the same total fees for essentially the same "product." However, this is not true because, if the billing was grossly out of line, (i.e., a reasonable and reasonably competent attorney would have spent half the time), then you have some justification in disputing the bill. You shouldn't have to pay for something that's clearly part of the attorney's learning curve.

Generally, however, the more experienced lawyers will spend their time more efficiently than the less experienced lawyers. So your $400 per hour lawyer (if you've satisfied yourself that they are rationally charging such a rate) should be significantly (not marginally) more efficient than your newbie lawyer, etc. It's up to you where you stand on the continuum of experience versus cost. The mid-career lawyers are probably the sweet spot in the curve for the consumer because they may not have ratched up their fees so high and they certainly know the ropes. In Southern California, it is not uncommon to see veteran family law specialists charging $500 or $600 per hour. (Aside - I once saw a family law specialist who charged $800 per hour. I nearly fainted...then nearly fainted again when I heard his client had paid $50,000 and the divorce was just starting!) With newbies likely charging their time out at $200 per hour and old guard specialists at perhaps $600 per hour, a seasoned "journeyman" lawyer of 10 or so years who may bill you around $300 per hour could be a wise and economical way to bring balance to the force...or, rather, your bank account and still get competent help.

As another aside, flat fee arrangements/unbundled services may be a way for consumers to cut costs of legal fees, but you should understand that you are only engaging someone for "piecework" and not full representation. You should remain alert at the wheel if your "ship" needs to change course or some wrinkle in the case comes up, such as an ex parte hearing. You still represent yourself and are only outsourcing certain tasks.

If possible, see if you can peg your lawyer down to an estimate of what your case is likely to cost. There are never any guarantees of course, because the other side might do something out of left field, but an experienced lawyer should be able to provide a range within which costs are likely to fall.

Of course, as the client, you would probably have some control over costs in that you would either approve or disapprove of a major discovery undertaking or the hiring of certain experts. Do you want to turn over every last stone or just the ones big enough to hid something under? The level of discovery and litigation can add considerable expense to your legal costs. A cost/benefit analysis might be done with your lawyer to assess the risk/reward and necessity of any particular course of action.

Conclusion

The above three factors, the ability of you and your lawyer to communicate, the experience level of your lawyer, and the cost of legal services, are three important things to consider when choosing legal representation. Each person has their own preferences, as one person may value communication more highy than experience and cost. For many people, price is definitely an object, and they're willing to settle for less in terms of the other two factors. Personally, I wouldn't settle on communication. There are enough lawyers out there so you can probably find with similar cost and experience profiles. Once you've decided on the cost/competence factors, communication does not cost anything extra, so it makes sense to find the lawyer with whom you can really work and with whom you can really communicate, all other things being equal.

The California Puppy Lemon Law, despite the rather specific name, is not limited to small dogs alone. It covers cats as well as dogs, and there are no age-related parameters. The California Puppy Lemon Law basically pertains to the California Health and Safety Code. It specifically concerns itself with a cat or dog's health at the time of purchase.

In essence, California Codes Health And Safety Code Section 122125-122220 defines the term 'pet dealer' of cats and dogs. Section 122125 states that this is a person who sells animals on a retail basis. It also states that a dealer requires an official permit for such a business. Further sections define that a 'purchaser' is any person who buys a pet from a dealer without intending to resell it.

A dealer is required to ensure that healthy animals are kept separately from those that are sick. In other words, there should be no doubt in a purchaser's mind that the pet purchased is healthy.

The California Puppy Lemon Law further states that a seller must make a purchaser aware of the benefits of neutering and spaying pets. The purchaser must be given written material supporting this. The dealer should additionally offer incentives for such procedures.

Further, the dealer must give documentation of every animal's heritage - the name and address of the breeder or broker. The purchaser must also be given the animal's date of birth and a vaccination/immunization/surgical record. The buyer is also supposed to receive a clear statement of any disease that the animal is suffering from at the time of purchase.

Under California Puppy Lemon Law, the dealer is legally liable if:

o The dealer has failed to maintain the specified health standards.

o A licensed veterinarian states in writing that the animal fell sick within 15 days of purchase.

California Boat Accident - Case Study - Boat Hits Water Skier

A maritime legal analysis is performed in order to illustrate boat accident negligence and vessel collision legal principals. This is a recreational boating accident in California.

A Case Study - A Boat Accident on Mission Bay

Picture this, a typically beautiful chamber of commerce weekend on Mission Bay in San Diego. It's Saturday morning at the beginning of spring, so the water park is busy, but not the zoo it will be in a few hours.

A ski boat is slowly towing a young girl and is going in the proper counter-clockwise rotation flow of traffic. As is usually the case in recreational boat accidents, a day of pleasure quickly turns to danger and danger in turn quickly turns to disaster.

A small inflatable power boat pops up from behind an anchored luxury yacht. The inflatable boat is going the wrong way. That is, clockwise, against the flow of traffic. Further, the inflatable boat is going way too fast. The ski boat driver takes the proper evasive maneuver to starboard and turns the ski boat in order to pass the inflatable boat port to port.

After passing the ski boat the inflatable boat driver takes a radical turn to port - - apparently in an effort to try and "catch air" over the ski boat's wake. The young girl's skis go under the inflatable boat, launching her and slamming her into the inflatable boat's engine, seriously injuring both of her legs and right arm.

Maritime Law Analysis: Rules of the Road Violations:

Federal Navigational Rules are also referred to as "Rules of the Road." The following is a thumbnail analysis of the Rules of the Road violations presented in this Case Study.

The young girl has a strong liability case against the operator of the inflatable boat. The inflatable boat operator is in violation of the following Navigational Rules:

Rule 5 - - Lookout

The vessel failed to keep a proper look-out.

Rule 6 - - Safe Speed

The vessel proceeded at a speed too fast for the conditions.

Rule 10 - - Traffic Separation Schemes

The vessel failed to proceed in the appropriate traffic lane in the general direction of traffic flow for that lane.

Rule 18 - - Responsibilities between Vessels

The vessel failed to keep out of the way of a vessel restricted in her ability to maneuver.

Defeating the Limitation Action

The inflatable boat was launched from the luxury yacht and is owned by the yacht owner. The yacht owner filed a Limitation of Liability Action in Federal District Court. The Limitation Action was defeated because the yacht owner was deemed to have privity and knowledge of the inflatable boat driver being up partying hard the night before and drinking 2 hours before the collision. The inflatable boat driver blew a.09 on the Breathalyzer and was booked by the San Diego Police for boating while under the influence.

Applying the Pennsylvania Rule

Under maritime law, when a vessel violates one of the Rules of the Road the burden rests upon the violating vessel to show not merely that their fault might not have been one of the causes, or that it probably was not, but that it could not have been. This is called the Pennsylvania Rule, or as I like to call it, "Check Mate." The Pennsylvania Rule is used to establish liability for boat collisions. Used properly, the Rule is a powerful weapon in boat collision lawsuits.

Case Result:

The insurance company for the yacht / inflatable power boat owner paid a high six figure settlement to the Guardian ad Litem of the young girl.

A Look at MICRA and Medical Malpractice in California

It is not the intent of this article to give an exhaustive treatise on MICRA, but rather to familiarize the reader with some of the highlights of the legislation that govern the prosecution of medical negligence cases from my perspective.

Although not strictly a personal injury case, most California personal injury attorneys consider medical malpractice to fall under the general banner of personal injury law. Many personal injury lawyers also practice medical malpractice law.

Specifically, medical malpractice is a case against a health care provider for substandard treatment of care recognized for medical practitioners in their community and causes further injury or death to a patient. The practice of medical malpractice law in California is governed by the Medical Injury Compensation Reform Act, or "MICRA" as it is commonly called. This Act, passed in 1975, regulates medical malpractice cases. The Medical Injury Compensation Reform Act is also in effect in a number of states around the country.

As the victim of a medical malpractice claim, one is able to collect, compensatory damages that may include the costs incurred around medical expenses, lost wages. A victim of medical malpractice may also be entitled to collect other special damages. Under the Medical Injury Compensation Reform Act restricts "general damages" or pain and suffering and emotional distress awards to a maximum of $250,000. The limit on the award for general damages holds true no matter how serious the injury caused to the victim.

The Medical Injury Compensation Reform Act also regulates attorney fees on a sliding scale that diminishes the amount paid to the attorney of the recovery. It must also be kept in mind that the costs of prosecution including costs of retention of expert witness and depositions are deducted from the settlement or court award prior to the calculation of attorney fees. In the typical personal injury case the usual custom and practice in the legal community is for attorney fees to be calculated as a percentage of the gross recovery.

The average person may think that regulating attorney fees and costs is advantageous to the consumer. This notion, in fact, is untrue; these types of regulations actually work against the consumer. Restricting the amount of fees an attorney can charge, changing the manner in which fees are calculated, and, most importantly, limiting the amount of general damages, makes it far more difficult for the victim of medical malpractice to find an attorney willing to represent their case. When injured victims cannot find counsel, the final result is often medical malpractice cases cannot be prosecuted in a cost effective and profitable manner. It is not uncommon for medical malpractice lawyers to speak to a prospective client who has already spoken to numerous attorneys trying to find representation, many times with no luck at all. Of course, discouraging medical malpractice cases was one of the primary objectives of MICRA as well as limiting just and deserved compensation to injured victims. It is also worth noting that the primary provision, including the limit on damages, has not changed since MICRA was enacted more than 30 years ago!

California Lemon Law: Refund Details

A person who qualifies as an aggrieved party under the California lemon law is entitled to a reimbursement by the manufacturer or dealer. He is entitled to get a replacement vehicle of the same make and quality. There are many fine details to be considered if the plaintiff desires a verdict that is favorable.

The first step in recovering the losses is arbitration. After 1986, vehicle and consumer good manufacturers are bound by law to assign a company called "the better business bureau" or BBB auto line arbitration, for judging the validity and the outcome of a claim. The BBB assigns an arbitrator who listens to the claims of the aggrieved party and judges the outcome of a case. The arbitrator also listens to the manufacturer's side of the story and decides whether the owner or aggrieved party is really entitled to the claim. If the arbitrator makes a decision in favor of the owner, then the owner immediately becomes entitled to a refund.

The next step is the courtroom trial and the outcome usually favors the plaintiff because the chances of receiving a refund are very good if the damage is irreparable. The compensation awarded to the owner is usually equal to the original cost of the vehicle. However, in many cases the judge has also awarded punitive damages to the owner, amounting to twice the financial loss caused by the damages. The other types of refund that a plaintiff may receive include the fees of the attorney and a refund for the out-of-pocket expenses that were incurred by the plaintiff, for repairing the vehicle.

The outcome of a case generally favors the plaintiff and there should be no hesitation on his part when it comes to fighting a case in court, if the damages are genuinely inherent and irreparable.
